Access to Services; Account Registration

By accessing the Services, you affirm that: You possess the legal capacity to enter into binding contracts. All registration information you provide is truthful and accurate.

You will uphold the accuracy of such information. Your utilization of the Services adheres to all applicable laws and regulations.

To access our Services, registration with the Site and creation of a user account (“Account”) are required. You bear sole responsibility for any activity conducted through your Account and for maintaining the accuracy of your information. Please refrain from sharing your Account details, and ensure the security of your Account and password. RESTRICTIONS ON CONTENT AND USE OF THE SERVICE

We reserve the right to access, review, preserve, and disclose any information as necessary to (i) comply with applicable laws, regulations, legal processes, or governmental requests, (ii) enforce the Terms of Service, including investigating potential violations, (iii) detect, prevent, or address fraud, security issues, or technical problems, (iv) respond to user support inquiries, or (v) protect our rights, property, safety, users, or the public.

We also reserve the right to report illegal activities to local authorities. Prohibited User Content includes material that is offensive, promotes discrimination or harassment, displays or links to explicit content, spreads false information, violates copyright or trademarks, or compromises the safety or privacy of others without consent.

Your use of any Content or materials obtained through the Service is at your own risk. We do not endorse, support, guarantee, or validate the accuracy, completeness, or reliability of any Content or communications posted via the Service, nor do we endorse any opinions expressed therein.

Payment Processor; Third-Party Service Provider

Third-party payment service providers may receive updated credit card information from your card issuer to prevent payment interruptions. If you prefer not to participate in this update service, please contact your card issuer directly. Our commitment to providing the Services commences upon receipt of your payment. Prices are inclusive of local taxes. We are not liable for any banking charges incurred as a result of payments made on your account. Furthermore, you are prohibited from reselling any Services for commercial purposes.

Subscriptions made in the UK will be subject to VAT our VAT number Is 467 9843 25.

Cancellation of Subscription

If you wish to cancel your subscription without closing your account, please email us at info@interactiva.design. To cancel your subscription and close your account, visit Profile >Close your account. Please note that no refunds will be issued for any portion of subscription fees paid for the current or prior billing periods.

For prompt processing, submit your cancellation request promptly, as requests are typically processed within 2 to 3 business days upon receipt. To improve our services, please share your reasons for requesting a refund or cancellation. Your feedback is valuable to us.

Fees and Subscriptions

The Service is billed monthly in advance and is non-refundable upon normal account termination. No refunds or credits will be issued for partial months of service or unused months with an active account. All fees exclude VAT, taxes, levies, or duties imposed by taxing authorities, for which you are responsible. Cancellation of your Service will lead to immediate and irreversible deletion of your Content.

Cancellations by Interactiva

We may suspend or terminate your use of the Services due to fraud or breach of these Terms. Such termination or suspension may be immediate and without notice. A breach includes unauthorised copying or downloading of content from the Services.

Change in Fees and Charges

We reserve the right to modify existing fees and charges or introduce new ones at any given time. We will provide written notification to you at least 30 days in advance of any such changes.

Eligibility; User Restrictions

Only individuals who are at least 16 years old, are authorised to use the Services. It is your responsibility to ensure that these Terms adhere to all applicable laws. You are accountable for ensuring compliance with the laws of your jurisdiction.

Use of the Services; Restrictions on Use

We reserve the right to develop, update, modify, restrict access to, or withdraw the Services at our sole discretion without prior notice. Any updates or changes will become integral parts of the Services and are subject to these Terms. You are only permitted to use the Services as authorised and in accordance with any available policies. Unauthorised use of the Services, including for commercial purposes, scraping, reverse engineering, or engaging in illegal activities, is strictly prohibited.  Links to Third-Party Websites We may offer links to third-party websites or services for informational purposes only. We do not review or endorse any of these websites or services, and we are not liable for their content, privacy practices, or availability.

Licence Limitations

Interactiva LTD grants you a limited, non-exclusive, non-transferable licence to use the Site in accordance with the terms of this Agreement. 

Intellectual Property

We maintain all rights, title, and interest in the Services, including technology, processes, trademarks, site design, text, video, graphics, logos, images, and icons. Unauthorised use of any content or materials on the Services violates intellectual property laws and is strictly prohibited. Availability of the Services

While we strive to offer the best service possible, we cannot guarantee that the Services will be fault-free. Please report any faults to info@interactiva.design.

Access to the Services may be temporarily restricted for repairs, maintenance, or the implementation of new features or Services. We will endeavour to restore the Services as promptly as possible.

Third-Party Materials and Content

The Services may include third-party content, data, applications, or links to third-party websites (“Third-Party Materials”). We are not responsible for the content, accuracy, completeness, timeliness, legality, or quality of Third-Party Materials.

Vendor Services

The Services enable connections between Users and Vendors for event- related services (“Vendor Services”). We do not control the quality, timing, or legality of Vendor Services. Users contract directly with Vendors. We do not confirm Vendor identities or assume responsibility for the accuracy of information provided through the Services. Exercise caution when interacting with Vendors. We are not responsible for the conduct of Users or Vendors, online or offline.

Release for the Vendor Services

The Services are a platform for connecting Users and Vendors. In the event of a dispute with one or more Users or Vendors, you release Interactiva (and our officers, directors, agents, investors, subsidiaries, and employees) from claims, demands, or damages arising from such disputes. 

Liability Limitations

Interactiva LTD, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any direct or consequential damages resulting from your use of the Site. You agree to defend, indemnify, and hold us harmless from any claims, losses, liability, costs, and expenses, including attorney’s fees, arising from your violation of any third-party rights.

Warranty Disclaimers; Limitation of Liability 

The services are provided “as is” without warranty of any kind. To the maximum extent permitted by law, we disclaim all representations and warranties, express or implied, relating to the services, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and freedom from computer viruses. We do not warrant that the services will meet your requirements or be fault-free. Our liability for damages arising from your use of the services is limited to the greater of (1) the total fees paid by you to us in the six months prior to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Interactiva LTD, its affiliates, licensors, service providers, officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your violation of these

Terms or your use of the Services.
Governing Law

These Terms and your usage of the Services are regulated by the laws of England and Wales, without regard to conflicts of laws principles. Any disputes will be exclusively subjected to the jurisdiction of the courts of England and Wales.

Arbitration

We may require you to submit disputes to final and binding arbitration under the Rules of Arbitration of the London Court of International Arbitration (LCIA), seated in London, England.

Severability

If any part of these Terms is invalid or unenforceable, that part will be limited or eliminated to the minimum extent necessary, and the remaining terms will remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Interactiva, superseding all prior communications and proposals. Any rights not expressly granted herein are reserved.

Force Majeure

We will not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including mechanical, electronic, or communications failure, strikes, labour disputes, delays, or the inability to obtain supplies.

Assignment

You may not assign these Terms without our consent. We may assign, transfer, or delegate our rights and obligations without consent. These Terms do not create any agency, partnership, joint venture, or employment relationship.

Waiver

Our failure to enforce any part of these Terms does not waive our right to later enforce that or any other part. Any waiver must be in writing from an authorised Representative.

Release

You release Interactiva from claims, demands, or damages arising from your use of the Services. Residents of England and Wales waive any applicable law regarding unknown claims. This release does not apply to claims of fraud, deception, or Misrepresentation.

Changes in Agreement

We may modify or replace these Terms and Conditions at our discretion by posting updated  terms on the Site. Your continued use of the Site after such changes constitutes acceptance of the revised Terms and Conditions.

Please check this Agreement periodically for updates. If you do not agree with any part of this Agreement or its changes, please refrain from using or accessing the Site and discontinue any use immediately.
